Estate Planning

Estate Planning can involve creation of a Trust Agreement, with a Pour-Over Will, a Trust Transfer Deed, an Advance Healthcare Directive, and a Durable Power of Attorney or it can be a simple as a Will and/or Revocable Transfer On Death Deed. It can involve complications such as a Substance Abuse Trust or you may need a Special Needs Trust or you may have other concerns we can definitely address. The initial estate planning consultation is free so we can determine your needs and quote you a flat fee for your estate plan. Then we draft a plan customized to fit your particular needs. We know that every client is different and select and draft the documents accordingly. With our expertise and personalized approach, you can trust us to protect your assets and ensure your wishes are fulfilled.

Navigating Probate Administration

If a probate is necessary, it can be confusing, time consuming, and expensive. You need someone you can trust to guide you through the probate process with care and expertise. With more than 40 years experience, Michele McGill understands the intricacies of the probate process and how to avoid the pitfalls and expedite the process as much as possible. Michele McGill will handle the usual probate proceeding based on the statutory fee provided by law.

Trust Administration

Trust Administration

Although a well-drafted Trust Agreement will greatly simplify the process of carrying out your plan upon your death, a Trust Agreement is not self-executing. There are steps that must be taken in administration of every trust. Where the trust involves the sale of a business, or a complicated family situation, or is poorly drafted, it may involve more steps which will cost more money. Due to the varied nature of Trust Administration, we charge hourly to guide the successor trustee through the process, whether it involves five steps or twenty-five steps.

Small Estates

You may be able to collect the estate of a decedent without probate if it is a small estate (Under a certain amount) without the formalities of a formal probate by using a Small Estate Affidavit to collect each asset. We can assist you in this process. You may also be able to avoid probate where decedent named certain beneficiaries, or pay on death beneficiaries, or other forms of joint ownership that also avoid probate. We can help transfer these assets as well. We will use our expertise to transfer assets in the most efficient way possible.

  • Why is estate planning important for my family's future?

Unfortunately, we know each of us will die, we just don’t know when.  The State of California has an estate plan for those who failed to plan called the law of Intestate Succession.  It may not be what you want to happen and it will probably require a formal Probate Administration which is both costly and time-consuming.  By taking control and making a plan you will avoid Probate Administration and your assets will be distributed in accordance with your wishes.  A competent and caring Estate Planning Attorney can also advise you about the most advantageous way to hold title, changes in the law affecting things like the Parent-Child Transfer Exemption, how to avoid Conservatorship, and changes in the federal estate tax threshold.  Ignorance of these matters is not bliss and can be costly.  Get it done right with a caring estate planning attorney by your side.
